Content – Terms of Use

Our Terms of Use (“Terms” or “Agreement”) also includes our Privacy Policy, and any other documents referred to by those agreements, and they, as a whole, govern any and all of the access to the platform, whether you are a visitor, guest, Tutor, Student, etc.

Our platform includes all of the sub-domains, mobile applications, any other media, location, application, etc. owned, managed, operated, etc. by us. When referring to the infrastructure in this Agreement, we will be collectively referring to them as the “Platform”.

Application and Acceptance of Terms and Conditions:

For the purposes of this Agreement, the terms “we”, “us”, “our” refers to “SCIGATE”. The terms “User”, “you” and “your” refers to you i.e. any person who accesses the Site for any purpose, regardless of whether said person has registered on the Site as a registered User or whether said person is a paying customer for a specific service provided by “SCIGATE” or its affiliates.

The platform may provide the opportunity for Tutors to sell offerings (“Coaching”) to Students in addition to the courses that the Creator sells on the Platform (together Coaching and courses are referred to as Content). All Coaching shall be covered by this Agreement and are included in the definition of Content. Should the Coaching involve any third party content, You agree that the platform is not responsible in any way for such content, and makes no representations or guarantees as to its merchantability or fitness of use. The delivery of the Coaching is the sole responsibility of the Creator.

User Provided Information

The Application/Website/Services/products obtains the information you provide when you download and register for the Application or Services or products. When you register with us, you generally provide (a) your name, age, email address, location, phone number, password and your ward’s educational interests; (b) transaction-related information, such as when you make purchases, respond to any offers, or download or use applications from us; (c) information you provide us when you contact us for help; (d) information you enter into our system when using the Application/Services/products, such as while asking doubts, participating in discussions and taking tests. The said information collected from the users could be categorized as “Personal Information”, “Sensitive Personal Information” and “Associated Information”. Personal Information, Sensitive Personal Information and Associated Information (each as individually defined under this Information Technology (Reasonable security practices and procedures and sensitive personal data or information) Rules, 2011 (the “Data Protection Rules”)) shall collectively be referred to as ‘Information’ in this Policy. We may use the Information to contact you from time to time, to provide you with the Services, important information, required notices and marketing promotions. We will ask you when we need more information that personally identifies you (personal information) or allows us to contact you. We will not differentiate between who is using the device to access the Application, Website or Services or products, so long as the log in/access credentials match with yours. In order to make the best use of the Application/Website/Services/products and enable your Information to be captured accurately on the Application/Website/Services/products, it is essential that you have logged in using your own credentials. We will, at all times, provide the option to you to not provide the Personal Information or Sensitive Personal Information, which we seek from you. Further, you shall, at any time while using the Application/Services/products, also have an option to withdraw your consent given earlier to us to use such Personal Information or Sensitive Personal Information. Such withdrawal of the consent is required to be sent in writing to us at the contact details provided in this Policy below. In such event, however, the Company fully reserves the right not to allow further usage of the Application or provide any Services/products thereunder to you.

Automatically Collected Information

In addition, the Application/products/Services may collect certain information automatically, including, but not limited to, the type of mobile device you use, your mobile devices unique device ID, the IP address of your mobile device, your mobile operating system, the type of mobile Internet browsers you use, and information about the way you use the Application/Services/products. As is true of most Mobile applications, we also collect other relevant information as per the permissions that you provide. We use an outside credit card processing company to bill you for goods and services. These companies do not retain, share, store or use personally identifiable information for any other purpose.

Use of your Personal Information

We use the collected Information to analyse trends, to conduct research, to administer the Application/Services and products, to learn about each user’s learning patterns and movements around the Application/Services and products and to gather demographic information and usage behaviour about our user base as a whole. Aggregated and individual, anonymized and non-anonymized data may periodically be transmitted to external service providers to help us improve the Application, products and our Services. We will share your information with third parties only in the ways that are described below in this Policy. We may use the individual data and behavior patterns combined with personal information to provide you with personalized content, and better your learning objectives. Third parties provide certain services which we may use to analyze the data and information to personalize, drive insights and help us better your experience or reach out to you with more value added applications, products, information and services. However, these third party companies do not have any independent right to share this information. We do not sell, trade or share your Information to any third party (except subsidiaries/affiliates of theCompany for related offerings) unless, we have been expressly authorized by you either in writing or electronically to do so. We may at times provide aggregate statistics about our customers, traffic patterns, and related site information to reputable third parties, however this information when disclosed will be in an aggregate form and does not contain any of your Personally Identifiable Information. SCIGATE will occasionally send email notices, messages or contact you to communicate about our Services, products and benefits, as they are considered an essential part of the Services/products you have chosen. We may disclose Information:

  • as required by law, such as to comply with a subpoena, or similar legal process;
  • to enforce applicable ToU, including investigation of potential violations thereof;
  • when we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, address security or technical issues or respond to a government request;
  • with our trusted services providers who work on our behalf, do not have an independent use of the information we disclose to them, and have agreed to adhere to the rules set forth in this Policy;
  • to protect against imminent harm to the rights, property or safety of the Application/Website/ Think and Learn Private Limited or its users or the public as required or permitted by law;
  • with third party service providers in order to personalize the Application/Website/Services/products for a better user experience and to perform behavioural analysis;
  • Any portion of the Information containing personal data relating to minors provided by you shall be deemed to be given with the consent of the minor’s legal guardian. Such consent is deemed to be provided by your registration with us.

Access to your Personal Information

We will provide you with the means to ensure that your Personal Information is correct and current. If you have filled out a user profile, we will provide an obvious way for you to access and change your profile from our Application/Services/Website/products. We adopt reasonable security measures to protect your password from being exposed or disclosed to anyone.

Cookies

We send cookies (small files containing a string of characters) to your computer, thereby uniquely identifying your browser. Cookies are used to track your preferences, help you login faster, and aggregated to determine user trends. This data is used to improve our offerings, such as providing more content in areas of greater interest to a majority of users. We may alert you by email or phone (through sms/call) to inform you about new service offerings of the Company and its subsidiaries/affiliatesor other information which we feel might be useful for you, through theCompany or its subsidiaries/affiliates.

When you use certain features on our website like the discussion forums and you post or share your personal information such as comments, messages, files, photos, will be available to all users, and will be in the public domain. All such sharing of information is done at your own risk. How Long Do We Retain User Data?

Currently, we plan to retain user data while an account is active and for at least three years afterward. We may alter this practice according to legal and business requirements. For example, we may lengthen the retention period for some data if needed to comply with law or voluntary codes of conduct. Unless otherwise prohibited, we may shorten the retention period for some types of data if needed to free up storage space.

General Rights In Operating the Platform

The platform reserves the following rights over the entire platform:

The platform may, but has no obligation to, monitor any content that appears on the platform or review any conduct occurring through the Platform, including any interactions between Tutors and Students.

The platform has, in its sole discretion, an absolute right to modify, change, alter, suspend, or terminate any provision of this Agreement without warning at any time

Errors and Corrections

The platform does not guarantee that the Platform or any services offered through the Platform will be error-free or otherwise reliable, nor does the platform guarantee that defects will be corrected or that any offerings through the Platform will always be accessible. The platform may make improvements and/or changes to the Platform and their features and functionality at any time, and will use commercially reasonable efforts to avoid disrupting peak hours, though some downtime may occur. Errors in Content are the responsibility of the Creator who owns the Content.

We reserve the right to amend the Platform, and any service or material we provide on the Platform, in our sole discretion without notice. We will not be liable if for any reason all or any part of the Platform is unavailable at any time or for any period. From time to time, we may restrict access to some or all of the Platform to Tutors and Students

By accessing or using the Site, you hereby agree to accept the terms and conditions set forth in this Agreement as the User. You shall be bound by the terms and conditions of this Agreement with respect to your access to or use of this Site, and any further upgrade, modification, addition, or change to this Site. If you do not accept all of the terms and conditions of this Agreement, then you should not access or use this Site.

The Agreement is applicable to the Site as a whole. However, certain sections of the Site may set out additional terms and conditions applicable for the User, which will be notified separately in such sections. Under no circumstances, shall the provisions of such terms and conditions prevail over this Agreement.

Access to some parts of the Site and some of its features are provided to all the Users free of charge. “SCIGATE” reserves the right to restrict access to any areas or features of the Site, without prior notice to any User.

You may use this Site solely for non-commercial purposes. You agree that you shall not copy, reproduce or download any information, text, images, video clips, directories, files, databases or listings available on or through the Site and the App for the purpose of re-selling or re-distributing, mass mailing (via emails, wireless text messages, physical mail or otherwise), operating a business that competes with the Site, or otherwise commercially exploiting the “SCIGATE” Content. In addition, use of the content or materials for any purpose not expressly permitted in this Agreement is prohibited.

“SCIGATE” is not responsible for the conduct of any User’s activities on the Site, and shall not be liable to any person in connection with any damage suffered by any person as a result of such User’s conduct.

This Agreement shall be governed by the laws of India with regard to its conflict of law provisions.

Only the User given express permission to administer a Page may administer such Page on the Site. “SCIGATE” reserves the right to block access to the Site if it suspects misuse of the administrator rights for a page.

“SCIGATE” reserves the right in its sole discretion to remove any material displayed on the Site which it reasonably believes is unlawful, could subject “SCIGATE” to liability, violates this Agreement or is otherwise found inappropriate In “SCIGATE” s opinion. “SCIGATE” reserves the right to cooperate fully with governmental authorities, private investigators and injured third parties in the investigation of any suspected criminal or civil wrong doing. Furthermore, “SCIGATE” may disclose your identity and contact information, if requested by a government or law enforcement body, an injured third party, or as a result of a subpoena or other legal action, and “SCIGATE” shall not be liable for damages or results thereof and you agree not to bring any action or claim against “SCIGATE” for such disclosure. In connection with any of the foregoing, “SCIGATE” may suspend or terminate your account as “SCIGATE” deems appropriate in its sole discretion that “SCIGATE” may take such actions.

Liability

“SCIGATE” will try to keep the Site ‘live’, bug-free, and safe, but you use it at your own risk. We are providing the Site “as is” without any express or implied warranties including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Site will be safe or secure. “SCIGATE” is not responsible for the actions, content, information, or data of third parties, and you release us, our directors, officers, employees, and agents from any claims and damages, known and unknown, arising out of or in any way connected with any claim you have against any such third parties. We will not be liable to you for any lost profits or other consequential, special, indirect, or incidental damages arising out of or in connection with this statement or the site, even if we have been advised of the possibility of such damages.

Any material downloaded or otherwise obtained through the Site, is done at your sole discretion and risk, and you are solely responsible for any damage to your computer system or loss of data that results from the download of any such material. No advice or information, whether oral or written, obtained by you from “SCIGATE” or through or from the Site shall create any warranty not expressly stated herein.

Intellectual Property Rights

“SCIGATE” is the sole owner or lawful licensee of all the rights to the Site and the “SCIGATE” Content. The Site and “SCIGATE” Content embody trade secrets and intellectual property rights protected under worldwide copyright and other laws

“SCIGATE”,and the related icons and logos are registered trademarks or trademarks or service marks of “SCIGATE”, in various jurisdictions, and are protected under applicable copyright, trademark and other proprietary rights laws. The unauthorised copying, modification, use or publication of these marks is strictly prohibited.

Notices

All notices or demands to or upon “SCIGATE” shall be effective if in writing and shall be duly made when sent to “SCIGATE” in the following manner to: “SCIGATE”, 4, CHALBAL WALA BUILDING, GHANCHI DHAL – MADAR AUTO ROAD, DHOLKA, DIST: AHMEDABAD STATE – GUJARAT.

For content that is covered by intellectual property rights, you specifically grant “SCIGATE” a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use any such content that you post on or in connection with the Site (“IP License”).

You should also have enrolled your Credit Card with VBV (Verified by Visa) or MSC (Mastercard Secure Code) to complete the transaction.

Refund Policy

Online preparation for competitive examination is a completely new experience, if for any reason you have any complaints or dissatisfied in any manner with a course/package subscribed to on “SCIGATE”, please do contact us.

Communication

When you use the website or send emails or other data, information or communication to “SCIGATE”, you agree and understand that you are communicating with us through electronic records and you consent to receive communications via electronic records from us periodically and as and when required. We will communicate with you by email or by notices on Website or electronic records on the website or on your mobile number which will be deemed adequate service of notice / electronic record to the maximum extent permitted under any applicable law.
